1. Introduction and Contractual Framework
These Terms and Conditions (“Terms”) constitute the legally
binding contractual provisions governing the supply of all products and
services by Wellnesshealth Ltd (“we”, “us”, “our”). By placing an order,
accessing our services, or otherwise engaging with our commercial offerings,
you acknowledge that you have read, understood, and agreed to be bound by these
Terms in full. These Terms may be amended periodically, and it is your
responsibility to review them prior to submitting any order.
2. Eligibility and Regulatory Disclaimers
You must be at least 18 years of age to procure any products
or services from us.
We are not a regulated healthcare provider and do not offer
medical advice, diagnosis, or treatment. All products and services are provided
strictly on a non‑clinical, informational basis and must not be construed as a
substitute for professional medical assessment.
No warranties, representations, or assurances are provided
regarding health‑related outcomes, improvements, or results.
3. Customer Obligations
You are responsible for ensuring that all information
supplied to us is accurate, complete, and up to date. You must comply with all
instructions, guidance, or procedural requirements issued in relation to our
products or services.
Failure to comply may affect service outcomes and may result
in additional charges.
4. Blood Testing Services
Where you purchase a blood testing kit or related service:
- Your sample will be
processed by a UK‑based laboratory operating in accordance with applicable
professional standards.
- You will receive a report
indicating whether your biomarker values fall within the reference ranges
for the tests undertaken.
- We do not diagnose
medical conditions or interpret clinical significance.
If your results fall outside expected ranges or if symptoms
persist, you must seek advice from a suitably qualified medical professional.
You are responsible for ensuring that any blood sample is
collected by a suitably qualified practitioner and for the lawful disposal of
sharps unless you use our nursing services.
5. Order Acceptance and Rejection
An order is deemed accepted only when we dispatch or supply
the relevant product or service and confirm such dispatch or supply.
We reserve the right to reject orders for reasons including, but not limited
to: stock unavailability, inability to verify age, geographical restrictions,
or pricing errors.
6. Pricing, Payment, and VAT
Prices are as displayed on our website and include VAT.
Subscription services are billed at the intervals disclosed during the order
process.
Interest may be charged on overdue payments at 2% per annum above the Bank of
England base rate.
VAT adjustments will apply if the VAT rate changes between
order and supply.
7. Delivery, Delays, and Variations
We are not liable for delays caused by events outside our
reasonable control, provided we notify you and take reasonable steps to
mitigate the delay.
Products may vary slightly from images displayed online.
8. Consumer Cancellation Rights
You may have a statutory right to cancel certain purchases
within 14 days, subject to exclusions including:
- completed services
- sealed goods unsealed
after delivery
- personalised or bespoke
goods
- goods inseparably mixed
with other items
Returned goods must be sent at your own cost and in
acceptable condition. Refunds will be issued within statutory timeframes.
9. Faults, Defects, and Consumer Remedies
If you believe a product or service is defective, you must
notify us promptly. We comply with all statutory obligations under UK consumer
law regarding the supply of goods and services.
10. Changes, Suspension, and Withdrawal
We may amend products, services, or these Terms to reflect
legal or regulatory changes or to implement minor technical adjustments.
Substantial changes will be communicated in advance, and you may terminate the
contract if you do not agree to them.
We may suspend or withdraw products or services with
appropriate notice.
11. Termination by Us
We may terminate the contract and seek compensation if you
fail to make payment, fail to provide required information, or fail to accept
delivery or service performance within a reasonable time.
12. Liability Framework
We exclude liability for losses that are unforeseeable,
caused by events outside our control, or avoidable through reasonable action.
We do not exclude liability for:
- death or personal injury
caused by negligence
- fraud or fraudulent
misrepresentation
- statutory rights under the
Sale of Goods Act 1979 or Supply of Goods and Services Act 1982
- defective products under
the Consumer Protection Act 1987
13. Data Protection
Personal data is processed in accordance with our Privacy
Notice.
14. Complaints
Complaints will be handled promptly, fairly, and in
accordance with our internal complaints procedure.
15. Assignment and Third‑Party Rights
We may transfer our rights and obligations under this
contract to another organisation. You may transfer your rights only with our
written consent. No third party has rights under this contract.
16. Severability and Enforcement
If any provision is deemed unlawful or unenforceable, the
remaining provisions shall continue in full force. Delay in enforcing rights
does not constitute a waiver.
